]]>Tue, 31 Jan 2017 13:09:39 GMThttp://www.crandellimmigrationlaw.com/blog/los-nuevos-mandatos-ejecutivos-del-presidente-trump-sobre-la-inmigracion-son-una-pesadilla-para-los-no-ciudadanosAl final del año 2017, Presidente Trump firmó una serie de ordenes ejecutivas, pretendiendo promover “seguridad pública” y “seguridad fronteriza,” varios de ellas afectan profundamente cómo la nueva administración hará cumplir la ley migratoria.  Las ordenes del Presidente tienen que ver con las prioridades del cumplimiento de las leyes migratorias, la colaboración de policía local con inmigración y la publicación pública de datos de crímenes cometidos por inmigrantes. 
 
Primero, las prioridades de cumplimento – efectivas inmediatamente – convierten a todos los no ciudadanos “deportable” – incluso residentes permanentes – en prioridades principales si: (1) han estado declarado culpable por cualquier delito; (2) han estado “acusado de” cualquier crimen aun si la acusación no se ha resuelto; (3) han “cometido actos que constituyen un delito criminal”, potencialmente aun si los cargos no se han presentados; o (4) si “[e]n la opinión de un agente de inmigración, [ellos] de otra manera conllevan un riesgo para la seguridad pública o seguridad nacional.”  Esto es una enorme expansión de las prioridades de cumplimiento de la previa administración y representa una amenaza seria y perturbador para todos los no ciudadanos que han tenido o podrían tener contacto con la policía por todas partes en los Estados Unidos.

]]>Fri, 27 Jan 2017 19:02:17 GMThttp://www.crandellimmigrationlaw.com/blog/president-trumps-new-executive-orders-on-immigration-are-a-nightmare-for-noncitizensAt the end of January 2017, President Trump signed a series of executive orders purporting to promote “public safety” and “border security,” several of which deeply impact how immigration laws will be enforced under the new administration.  The President’s orders involve ICE enforcement priorities, state and local law enforcement collaboration with ICE, and the reporting of data regarding crimes committed by immigrants.
 
First, the new broadly phrased ICE enforcement priorities – effective immediately – make all “removable” noncitizens – including LPRs – top priorities for deportation if they: (1) have been convicted of any crime; (2) have been “charged with” any crime where such charge has not been resolved; (3) have “committed acts that constitute a chargeable criminal offense,” potentially even if charges have not actually been filed; or (4) if “[i]n the judgment of an immigration officer, [they] otherwise pose a risk to public safety or national security.”  This is an enormous expansion of the previous administration’s priority categories and represents a serious and troubling threat to any noncitizen who has had or may have contact with law enforcement anywhere in the United States.
           
Worse yet, President Trump furthermore declared that the executive branch will empower state and local law enforcement to enforce federal immigration laws “to the maximum extent permitted by law.”  In doing so, he has directed the Secretary of the Department of Homeland Security (“DHS”) to work with state and local law enforcement to enter into the “287(g)” agreements which allow local officers to investigate and detain noncitizens for ICE.  Currently, Frederick and Harford County are the only participants in the program in Maryland.  President Trump, moreover, has told DHS to identify “sanctuary jurisdictions” and stop giving them federal grants.  Finally, the Attorney General and Secretary of DHS have been told to collect data and publicly release reports on “the immigration status of all convicted aliens incarcerated in State prisons and local detention centers” in the U.S.

During his time in the Marines, Kelly served in both the Persian Gulf War and the Iraq War.  Subsequently, he served as the commander of the United States Southern Command, the arm of the Marines responsible for military operations in Latin America and the Caribbean. As the leader of the Southern Command, Kelly fought to disrupt illicit drug rings in South and Central America, and he  oversaw military operations at Guantánamo Bay. 
 
As the Secretary of Homeland Security, Kelly would be in charge of all immigration agencies, including Immigration and Customs Enforcement (ICE), Customs and Border Protection (CBP), and U.S. Citizenship and Immigration Services (USCIS). Although the Secretary cannot directly create immigration policy, he has the authority to enhance enforcement measures and alter the processes through which immigration applications are adjudicated. The President, on the other hand, is empowered to unilaterally affect immigration policy by executive order which is then implemented with the collaboration of the Secretary.
 
Kelly and Trump see eye-to-eye on many immigration issues. Kelly warned at a Senate Armed Service Committee hearing that human smugglers trafficked “tens of thousands of people” into the U.S. with “relative ease” and that “these smuggling routes are a potential vulnerability” to the country, echoing some of the anxieties that Trump has propagated. Trump claims that “[Kelly] is the right person to spearhead the urgent mission of stopping illegal immigration and securing our borders.”

Closings and delays for the Baltimore Immigration Court are announced under the name "FEDERAL EXECUTIVE BOARD" on WBAL and WJZ.  When the Court opens on a delay, all cases scheduled to begin before the delayed opening time will be automatically rescheduled and Respondents on those dockets are not expected to appear.  Cases scheduled to begin on or after the delayed opening time will go forward, and Respondents on those dockets must appear.  

Baltimore ICE/ERO
Closings and delays for the Baltimore ICE/ERO office are also announced under the name "FEDERAL EXECUTIVE BOARD" on WBAL and WJZ.  When the office is closed, those with check-in appointments are expected to report on the next business day.

Antes de convertirse en senador, Sessions trabajó como un fiscal federal para el distrito sureño de Alabama. En el 18 de noviembre, Sessions fue nominado por presidente electo Donald Trump para ser el próximo Procurador General de los Estados Unidos.
 
Durante su carrera, Sessions ha patrocinado creencias que ponen en duda su respeto para la justicia y para gente de otras razas, nacionalidades y religiones. ]]>Mon, 28 Nov 2016 20:13:59 GMThttp://www.crandellimmigrationlaw.com/blog/why-attorney-general-jeff-sessions-is-a-threat-to-non-citizens-living-in-the-united-statesJefferson Beauregard "Jeff" Sessions III, born in 1946 in Selma, Alabama, is currently a Republican U.S. Senator from Alabama and is viewed as one of the most conservative members of the Senate.  Before becoming a U.S. Senator, Sessions served as a U.S. Attorney for the Southern District of Alabama.  On November 18, 2016, Sessions was nominated by President-Elect Donald Trump to be Attorney General of the United States. 
 
During Sessions' career, he has espoused beliefs that call into question his respect for justice and for people of other races, nationalities, and creeds.  For example, Sessions was once denied a position as a federal judge after colleagues testified before a Senate Judiciary Committee that he had spoken disrespectfully to a black lawyer and joked that the KKK was "OK."  Sessions has also advocated against advancements in racial and gender equality, voting rights, and due process for immigrants.  In fact, Sessions has consistently fought against practical immigration reform, while calling for drastic restrictions on visas and expansion of immigration enforcement.  In 2006, Sessions claimed before the U.S. Senate that "almost no one" coming to the U.S. from the Dominican Republic had a "provable skill that would benefit us," and falsely accused all Dominican immigrants of creating fake documents in order to enter the U.S. 
 
As Attorney General, Sessions' influence on immigration law would be far-reaching. Sessions, for example, could single-handedly revoke the highest immigration review board's decisions on protection from persecution and analysis of state and federal criminal statutes.  Additionally, he could implement measures to hinder access to legal representation for immigrants. And, as Attorney General, Sessions would be authorized to empower local law enforcement officials to work as immigration agents, thereby vastly increasing enforcement of existing immigration laws.
